The Contracts Group have substantial experience in dealing with claims. Our senior staff are all experienced and conversant with the mechanisms and remedies included in major forms of contract for claiming additional time and / or cost.
The preparation and defence of such claims requires a clear understanding of the contractual and legal principles which underpin each claim, the ability to fully understand and interpret the conditions of the particular contract, and the methods of calculation and presentation which may be adopted.
The Contracts Group are able to:
- Prepare extension of time and / or request for additional payment (combined as a Compensation Event under NEC) claims on behalf of our clients;
- Review and respond to claims received from our Clients supply chain;
- Provide specific advice to our Clients on any particular issue related to a claim or on the strategy related to its contents or submission.
- Negotiation and settlement of claims.
The negotiation and settlement of claims requires a knowledge of the strengths and weaknesses of each claim in order that negotiation strategies can be developed and each situation can be assessed to determine whether to settle or proceed with the dispute. Our senior staff have developed negotiation skills during their many years in the construction industry, and are also aware of the various alternative dispute resolution (ADR) strategies which may be available. We can advise clients on these strategies as required. However, our ultimate goal is always to strive to stop claims escalating into formal disputes, where possible.
