Avoiding Disputes
Early advice can help prevent disagreements from becoming formal disputes. We review emerging issues, relevant contractual requirements and project records, and assist with clear correspondence, substantiation and discussions between the parties.
Our aim is to identify opportunities to resolve matters while keeping the project and the client’s commercial objectives in view.
Managing Disputes
When a dispute arises, we help establish the facts, define the matters in disagreement and develop a strategy suited to the client’s objectives. This can include reviewing claims and responses, assessing time and cost issues, identifying gaps in the evidence and preparing clear submissions.
We work with clients and, where appointed, their legal advisers to coordinate the commercial and technical input needed as the matter develops.
Supporting Resolution
We assist with negotiation and settlement discussions and provide specialist support for mediation, arbitration, adjudication and litigation. Our approach combines detailed preparation with a continuing assessment of opportunities for settlement.
Where expert evidence is required, our Directors and specialist staff can assist with quantum, delay and programming analysis and expert reports.
